It is retarded. It's a restriction on the freedom of speech.

America has been in a state of emergency since sometime like 1960, giving the president the ability to ban free speech, censor the media and relocate citizens and property.

Yeah, I read that a while back.  It has been used, too.  Numerous times it has censored political leaders when on the topic of UFOs.  (for reasons of national security).
