Isn't that just saying that Bethesda sued Interplay? I heard about that a while back, but I heard Bethesda only granted them to use the NAME fallout, not any of the characters or anything like that... which was what Interplay was going for. I didn't read your whole article... but it seemed to be saying that the rights went back to Bethesda and they plan on doing nothing with them. Then again I have a headache and don't really want to read right now XD Though I would play the hell out of a FalloutMMO.

Nope. Bethesda won. Interplay sat on the license for too long, and Bethesda basically challenged them for ineptness.

Trademark law is silly. If you don't challenge things that could possibly infringe upon trademark, you actually risk losing it.
That being said, lawyers are also silly.
