This actually, though breaking laws itself will probably happen.
Though there methods will probably not work, a virus attached to an email will be wiped away, and hacking into a wireless network will only work if the person has no good firewall and the PC is turned on.
It's not like they're doing random hard drive checks. They're just telling people that they can now check suspects' HDs for emails, IM logs, and stuff like that for incriminating details without needing a warrant.
